Terms and Conditions

1. Definitions

1.1 The Guarantor: Refers to any individual who signs these terms and conditions and accepts full responsibility for the payment of Luna-C Aesthetics’ invoice. The Guarantor remains liable for any outstanding balances unless fully settled by the client.

1.2 Luna-C Aesthetics: Includes its holding, subsidiary, and associated companies, as well as all directors, officers, employees, and/or agents of the company.

2. Introduction

These terms and conditions govern the relationship between Luna-C Aesthetics and the client. By engaging Luna-C Aesthetics’ services, the client agrees to be bound by the provisions set out herein.

3. Payment Terms

The client agrees to make full payment of the fees for the use of Luna-C Aesthetics’ services as per the prevailing fee structure, which is available upon written request. Payment must be made in full prior to confirming any booking. No appointment will be confirmed until full payment is received.

4. Credit Information

The client consents to Luna-C Aesthetics obtaining information from any credit bureau or other financial institution regarding the client’s credit profile and payment history.

5. Consent to Magistrate’s Court Jurisdiction

The client consents to the jurisdiction of the Magistrate’s Court, as per Section 45 of the Magistrate’s Court Act, for any legal proceedings initiated by Luna-C Aesthetics in connection with the client’s failure to make payment or any other breach of these terms and conditions, regardless of the claim amount.

6. South African Jurisdiction and Law

This agreement and any services provided by Luna-C Aesthetics are governed by the laws of the Republic of South Africa.

7. Address for Notices

The addresses provided by the client are accepted as the chosen domicilium citandi et executandi for all purposes, including the service of court documents, payment of amounts due, and any communications between the parties.

8. Disclaimer Regarding Property

The client acknowledges that Luna-C Aesthetics shall not be held liable for any loss, damage, or destruction of the client’s property, including but not limited to money, valuables, or other personal belongings, however such loss, damage, or destruction may occur.

9. Consent to Process Personal Information

The client consents to Luna-C Aesthetics and its associated third parties processing their personal information for the purposes of providing services. The client further consents to the sharing of such information with third parties as required for the provision of similar services.

10. Treatment of Minor Clients

For clients who are unmarried minors under the age of 18, the minor’s parents and/or guardians are required to sign these terms and conditions and will be held personally responsible for the payment in full.

11. Appointment Cancellations

Cancellations will only be accepted if made at least 12 hours prior to the scheduled appointment. Cancellations must be communicated via telephone or electronic mail.

12. No Show Policy

Should the client fail to attend their scheduled appointment, the full cost of the appointment will be charged. No refund will be provided for missed appointments, and payment for the missed appointment must be made before any future appointments are scheduled.

13. Late Policy

In the event of a late arrival by the client, the appointment may be forfeited if there are no available slots later in the day.

14. Special Rates

Treatments purchased at special or promotional rates are non-refundable. The client must initiate the treatment within two months of purchase unless otherwise stipulated.

15. Cancellation of Payment Plans

If the client cancels a treatment payment plan, a cancellation fee of 10% will be charged. This fee applies to both during and after the scheduled payment period.

16. Refunds

All treatments, including those purchased under special offers, are strictly non-refundable.

17. Agreement to Terms

By signing below, the client confirms that they have read, understood, and agreed to these terms and conditions, including the disclaimer regarding personal property.
